Duration: 8 months (with possibility to extend)
SUMMARY
The Legal Consultant will support the Legal Counsel to provide legal advice for the operations and program work of Energy Foundation China. He/She will work with the internal staff and external lawyers to ensure full compliance with all relevant laws in both China and the U.S.
ESSENTIAL DUTIES & RESPONSIBILITIES
- Draft, review and negotiate variousagreements and contracts, including but not limited to Grants Agreements, Foundation-initiated-project (FIP) contracts, and service agreements etc.
- Review and provide legal advice on grants, projectsand activities from legal and risk management perspective, support the development of processes and proceduresto ensure legal compliance.
- Preparebilingual version of contracts and other legal documents as needed, under supervision of Legal Counsel.
- Assist to organize internal legal compliance and risk management training.
- Provide legal advice on day-to-day operations, and contribute to the formulation of office policies from legal perspectives, e.g. Conflict of Interests policies, Whistle Blower policies, etc.
- Support iNGO law compliance work, including but not limited to annual work plan, annual report, and other administrative and filing processes.
- Support Legal Counsel to develop standard template of legal documents for EF China to enhance risk controls.
- Undertake legal research and other additional tasks and responsibilities as assigned by Legal Counsel.
- Back up other colleagues as needed.

REQUIRED KNOWLEDGE, SKILLS & ABILITIES
- Education: Master’s degree or equivalent, majored in law. PRC bar is a must and U.S. bar admission (any state) is preferred.
- Working experience: Above 5 years of legal experience. Experiences in in-house counsel at non-profit organizations and knowledge in iNGO-related laws will be a strong plus.
- Language level: native-level Chinese skills required; excellent command of spoken and written English; communicates in English effectively in public.
- Communication: ability to communicate logically and articulate key messages/points with clear structure and fact-based supporting arguments, listen actively to audience’s purpose, and communicate effectively in public.
- Problem solving: ability to define and prioritize the key issues when facing complex situations, make analysis with logical reasoning, propose possible solutions and resolve some complicated issues independently, well balance between internal control and flexibility, aiming to achieve organizational goals effectively and efficiently.
